Terms of Service

HoloFail helps you identify Pokémon TCG cards, compare guide prices and organise a collection on your device. Scans can be wrong, prices are estimates, and your collection needs your own backup. These terms explain the service and protect the rights you have under applicable law.

1. The service and its operator

HoloFail is an independent project run by a solo developer based in Finland. “HoloFail”, “we” and “us” mean that operator. Contact: hello@holo.fail. These terms cover the web app and its installed home-screen version at holo.fail and the current cardglint.prokkis.com address.

You may use the service subject to these terms and applicable law. If you do not accept them, stop using the service. The current app is free, with no account, subscription, checkout or scan credits. Your mobile network or internet provider may charge for data. Any future paid feature would require a separate offer and your affirmative purchase; these terms do not authorise a charge.

The Privacy Policy separately explains data handling, including Cloudflare hosting and any future optional analytics. Accepting these terms is not consent to analytics or other optional processing.

2. Younger collectors

Younger collectors should use HoloFail with a parent or guardian who can help them understand these terms, protect their device and make decisions about cards. If the law requires an adult’s agreement for your use, obtain it. These terms do not give a child legal capacity they otherwise lack or make a parent responsible beyond applicable law.

HoloFail has no public chat or in-app buying, selling or trading. A shop reached through an external link has its own age and purchase rules. Children should ask a trusted adult before following a shop link, sending personal information or making a trade or purchase.

3. Recognition limits

The scanner compares a camera frame or chosen photo with a catalogue of supported physical Pokémon TCG cards. It suggests a printing, and it can return no result or the wrong one. Sleeves, glare, damage, camera quality, reprints and missing catalogue entries can affect recognition. Similar artwork or a successful scan does not prove a card is genuine.

HoloFail does not authenticate cards, detect every counterfeit or alteration, grade condition, establish ownership or provide a professional appraisal. Check the card’s set, number, language, edition, finish and condition yourself before relying on a result. The catalogue currently focuses on physical English cards; Pokémon TCG Pocket cards are not included.

Recognition runs on your device. We do not receive your camera frames or chosen photos, and these terms give us no licence to publish them, sell them or train models with them. Use photos you are entitled to use and avoid photographing people or private information.

4. Prices and collection values

HoloFail displays source-labelled observations, principally from Cardmarket and TCGplayer, prepared through our data sources. Available metrics and dates differ. Updates are periodic, not a live price feed, and a recent app update does not mean every observation is recent. Sources remain separate; a displayed range is not a promise that a buyer will pay within that range.

Values concern raw, ungraded cards. They may be incomplete, delayed or mismatched and do not assess the actual condition or finish of your card. A headline can use the highest available comparable guide value across finishes. Collection totals multiply catalogue guide values by your saved quantities and omit unavailable prices. They do not record purchase cost or prove a realisable sale value, profit, ownership or insurance value.

Actual proceeds depend on authenticity, condition, edition, finish, demand, marketplace, fees, taxes and shipping. Currency conversion uses European Central Bank reference rates, with their own dates; they are not exchange rates offered for a transaction. Prices and totals are reference information, not offers to buy or sell, appraisals or financial, investment, tax, insurance or legal advice. Verify information independently before acting.

5. Your collection and backups

Your collection is saved in your browser on your device. Scanning alone does not add a card: you choose what to collect. Saved entries contain card IDs, quantities and addition dates, not photos, condition grades, purchase prices or a guaranteed historical valuation.

Export collection in Settings downloads your backup; Import collection lets you merge or replace entries after reviewing a preview. Export regularly and before clearing site data or changing devices, browsers or domains. An import in Replace mode replaces existing entries. We have no server copy from which to recover your collection. Device failure, browser storage removal or a failed save can cause data loss; check that important changes saved and keep a backup somewhere you control.

You retain any rights you have in your own photos and collection records. We acquire no ownership in them and no licence to publish your collection. Export does not grant new rights in third-party card artwork or data. The Privacy Policy explains local storage and what happens if you deliberately send us a backup for support.

6. Branding and intellectual property

HoloFail is not affiliated with, endorsed, sponsored or approved by Nintendo, Creatures Inc., GAME FREAK inc., The Pokémon Company, TCGdex, PokeWallet, Cardmarket, TCGplayer or any other source or marketplace named in the app. Pokémon names, characters, card text, artwork and related marks belong to their respective rights holders. Marketplace data and other third-party material remain subject to the rights and licences that apply to them.

We display third-party material to help identify, compare and understand cards and attribute sources. We do not claim ownership of that material or grant permission to reuse it beyond applicable law and licences. HoloFail’s original work and third-party software have their own rights; the applicable open-source licences and notices continue to govern any code or other material supplied under them. These service terms do not override those licences.

To report an inaccurate attribution or possible infringement, email hello@holo.fail with the affected URL or card ID, the work or right concerned, an explanation and contact details. If acting for someone else, explain your authority. We will review the request promptly, may ask for necessary clarification and will correct, restrict or remove material when warranted or required by law.

7. Permitted and prohibited use

You may use HoloFail for lawful card identification, browsing, price research and managing your own collection. Normal browser downloads, caching, home-screen installation and the app’s collection export/import features are permitted. This does not grant bulk access to our hosted data or rights in someone else’s content.

You must not:

  • misrepresent a scan or price as proof of authenticity, grading or guaranteed value, or use the service to deceive others;
  • bypass security or rate controls, access non-public infrastructure without permission, introduce malicious code or disrupt other users;
  • automate requests in a way that creates unreasonable load or cost;
  • systematically harvest or bulk-download the hosted catalogue, artwork, models or prices without permission;
  • resell or redistribute material without the necessary rights, or falsely imply endorsement by HoloFail or a rights holder; or
  • otherwise use the service unlawfully or infringe another person’s rights.

These restrictions do not limit rights granted by an applicable open-source licence or activity that mandatory law permits despite a contractual restriction. They do not restrict your use of your own collection backup. Contact us about data-access or security-research requests before accessing anything outside normal public functionality.

8. External marketplaces

Links to Cardmarket, TCGplayer or other sites take you to a separate service. HoloFail does not operate a marketplace, receive your order, arrange a trade or act as a buyer, seller, agent, payment provider or guarantor. Check the destination’s current price, seller, terms, privacy policy, age requirements and purchase protections. We remain responsible for our own conduct to the extent required by law.

9. Availability and updates

HoloFail is maintained by one developer. We aim to provide a useful service with reasonable care, but do not promise continuous availability, support at a fixed time, compatibility with every device or identification of every card. A working internet connection and a compatible browser are needed. Home-screen installation does not guarantee offline scanning.

We may update or change the app and its data for security, compatibility, accuracy, maintenance, legal requirements or sustainable operation. An update can be required when the current version or data is no longer compatible. We may suspend or discontinue a feature for those reasons. Where reasonably possible, we will give advance notice of a significant reduction or planned closure and an opportunity to export your collection. Urgent security or legal action may require immediate changes. Mandatory rights to updates, conformity or remedies remain unaffected where they apply.

10. Responsibility and liability

You are responsible for reasonable care of your device, permissions and backups, and for independently checking card information before a transaction. This does not transfer to you responsibility that the law places on us.

Subject to the protections below, the free service is available in its current state and without an additional contractual guarantee of recognition accuracy, market value or uninterrupted operation. To the extent law permits, we are not responsible for business losses, lost profits or indirect or consequential loss arising from use of the service. Whether another loss is recoverable depends on applicable law and the circumstances.

Nothing in these terms excludes liability for fraud, intentional misconduct or gross negligence, or any liability that cannot lawfully be excluded or limited, including applicable personal-injury and data-protection liability. Mandatory consumer rights and remedies prevail over these terms.

11. Ending use and access restrictions

You can stop using HoloFail at any time without cancellation charges or an account-deletion request. Export your collection if wanted, then clear site data and remove the home-screen shortcut if installed. Clearing site data does not delete files you exported elsewhere.

We may limit requests or restrict access reasonably necessary to address abuse, security threats, material breaches or a legal requirement. Contact us if you think a restriction is a mistake. We will review it and explain the reason where lawful and safe. Ending use does not erase rights or liabilities that already arose, or prevent a privacy request.

12. Finnish law and resolving disputes

These terms are governed by the laws of Finland. If you are a consumer, this choice does not take away protections of mandatory law in your country of habitual residence that would otherwise apply. Your statutory privacy and consumer rights are not waived by using a service hosted outside Finland or the EU.

Please contact hello@holo.fail so we can try to resolve an issue. This is not a mandatory waiting period or a condition for exercising legal rights. A dispute can be brought before a court with jurisdiction under applicable law, including a consumer’s home courts where that right applies. These terms do not require private arbitration or waive access to courts, regulators or statutory collective remedies.

Where your issue falls within their remit, Finland’s Consumer Advisory Services can advise, and the Consumer Disputes Board can consider a consumer dispute. The Board issues recommendations rather than binding court judgments. Their competence depends on the parties and the type of dispute. Privacy complaints follow the route explained in the Privacy Policy.

13. Changes to these terms and contact

We may revise these terms to reflect service changes, legal requirements or a necessary clarification. We will publish the revised version with an effective date and give reasonable advance notice of material changes through the app or website, unless an urgent legal or security reason requires a shorter period. Changes do not retrospectively alter an existing dispute or accrued rights. Where law requires fresh agreement, we will obtain it; merely posting new terms does not replace that requirement.

If you do not accept a material change, you can stop using the service and keep your exported collection. An invalid term is ineffective to the extent required by law; the rest remains effective where it can fairly operate. A delay in enforcing a right does not waive it. These terms do not override mandatory law, separate applicable licences or an express commitment we have made to you. Save a copy using your browser’s print or save function.
